FOUNDRY 8 BUDD, LLC TERMS & CONDITIONS
RESERVATIONS
In order to secure a reservation, the client will provide Foundry 8 Budd with a 25% deposit, accept these terms and conditions, and provide Certificate of Insurance prior to the studio rental day. Your reservation includes use of the areas labeled on the Floorplan on our website:
Studio + Lobby: Photo Studio, Commercial Shot-In Kitchen, Dining Area, Office 1, Office 2, Lobby
Research Room + Lobby: Viewing Room, Research Room, Lobby
Mixer w/Breakout Rooms + Lobby: Photo Studio, Kitchen, Dining Area, Office 1, Office 2, Lobby
CANCELATIONS
Cancelations and rescheduling must be in writing, no less than 72 hours prior to the studio rental day for a full refund. If Foundry 8 Budd receives no written notice of cancellation, the client shall forfeit their deposit. If client cancels their reservation, with less than 24 hour notice, the full invoice for their booking will be charged to the credit card on file.
If the client does not arrive, within 1 hour of their reservation time, the client shall forfeit their reservation. This will be treated the same as a cancelation, with less than 24 hour notice. If the client requires Foundry 8 Budd to keep a reservation open for more than 1 hour, without attendance, the client must notify Foundry 8 Budd in writing.
INSURANCE REQUIREMENTS
Client shall provide Foundry 8 Budd with a Certificate of Insurance evidencing Client’s maintenance of a policy of comprehensive insurance in the amount of $1,000,000 per occurrence. If a claim occurs, Client is responsible for paying any deductibles. Foundry 8 Budd must be named as loss payee
RENTAL HOURS
The studio rental rate is based on a 9 ½ hour full day. Full day rentals will be booked 8am-5:30pm.
OVERTIME
There is a 15-minute grace period, after which, overtime fees will begin to be charged. The overtime rate is $115/hr.
This rate does not include taxes or any additional fees incurred.
PAYMENT
Payment is due in full before or on the studio rental date. If any additional hours are added on to the shoot, that amount will be added on automatically to your total Remaining Balance and will be billed to the Client's credit card on file.
*All clients will be charged tax unless the appropriate exemption forms are provided prior to or on your studio rental date.
**Clients are required to CHECK OUT with Front Desk prior to leaving.
SECURITY DEPOSIT
A security deposit or credit card hold will be required if you rent equipment equal to the replacement cost of all rentals. Any additional credit card fees accrued by Foundry 8 Budd will be charged to the client.
TRASH REMOVAL
There is a maximum of 5 trash bags included in your rental rate. Additional bags will be charged at the rate of $5 per bag. All trash bags must not be fully stuffed and easily lifted out of the garbage bins. If there will be an excessive amount of garbage in total, special pickup arrangements need to be made prior to your rental date by contacting us in writing so we can arrange the special pickups for an additional fee. All trash bags should be tied and placed in the dumpster behind the building. Please empty all liquids prior to placing in trash bins. Any seamless paper, cardboard, boxes, production materials (paper, etc.) must be cut up and taped up in a condensed orderly fashion prior to you leaving the studio. Items left after 7 days will be assumed abandoned and may be discarded or kept by the Company for Company use, with no compensation due the renter, at the discretion of the Company.
Please leave the studio as it was delivered:
• Sweep studio
• All studio equipment returned as found
• Dishes washed, countertops wiped clean
• Trash bagged
Client is responsible for leaving the studio as clean as they found it. Please broom clean, wash all dishes and bag all trash/recycling. If Renter does not return Premises to the order and cleanliness found when Renter arrived, Company will charge at minimum, a $100 cleaning fee.
STUDIO DAMAGE
The client accepts responsibility for any & all damage to the walls, floors, equipment, fixtures, appliances, couches, props & anything housed or affixed on or inside the studio during the time of their booking. The client is responsible for replacing any missing or damaged equipment as well as returning the studio to the same condition as it was at the beginning of their rental.
INDEMNIFICATION ON PREMISES
Foundry 8 Budd shall not be responsible or liable to Client, or any person claiming, by, through, or under Client, for any loss or damage to any property or business in the premises. Foundry 8 Budd shall not be responsible for any accident or injury, including death, to any of Client’s employees, agents or invitees in or about the Demised Premises.
Client agrees to indemnify and hold harmless Foundry 8 Budd, its officers, directors, partners, employees, and agents of the Demised Premises or any portion thereof, from and against any and all claims, actions, damages, liabilities, losses, costs and expenses, including attorneys’ fees.
LIABILITY
The client hereby accepts full responsibility for the replacement costs of any damages or loss incurred during their time in Foundry 8 Budd.
The Client agrees to leave the studio in the same condition as it was prior to their rental, and to pay for any injury or damage that may occur directly through their use. Foundry 8 Budd reserves the right to charge the Client a Cleaning Fee if studio is not left in same condition as it was prior to their rental.
All reimbursements must be made within (5) working days after presentation by the Owner, and will be billed to the Client's credit card on file.
DELIVERIES / PICKUPS
Any deliveries or pickups before or after the booking must be pre-arranged with Foundry 8 Budd in writing. Additional fees may apply.
OVERNIGHT STORAGE
Overnight Storage may be pre-arranged at an additional fee.
MISCELLANEOUS
The client may be provided with 1 key card if needed. Each additional key card will be billed at $25/each. If key cards are lost or stolen, the client agrees to pay $100, for the replacement of each key card lost.
This Studio Booking Confirmation and the use of the studio contemplated herein shall be exclusively governed by and construed in accordance with the laws of the State of New Jersey.
This Studio Booking Confirmation contains the entire understanding between the parties and supersedes any prior agreements or understandings whether written or oral.
Foundry 8 Budd does not authorize its agents to sign any 3rd party agreements on its behalf.
